As per the will, she had absolutely no legal right to remain in the home she had lived within for a number of years, and she had no right to ask for financial support from his sons. Essentially, the widow was left with absolutely nothing when the farmer passed away.
The widow consulted the aid of a solicitor and launched proceedings against the sons, on the grounds that the farmer had lacked the mental capacity to validly create a fair and a just will. Evidence was found that the farmer had drafted the will when he was suffering from advanced stages of his dementia, and had been suffering from confusion and forgetfulness, where he often did not recognise his wife at all.
The assistance of a STEP-Qualified solicitor which understood the extent of the farmer’s illness and the situation the wife endured meant that the High Court, while rejecting arguments that the sons had brought undue influence upon the farmer in the drafting of the will, meant that the court ruled in favour of the widow, who got to keep the home that she had shared with her husband.
